Description
The protection of the weaker contracting party has led the legislator to enact regulations that protect the mortgage debtor. Among these regulations are those aimed at preventing the early termination of the loan, clarifying when non-compliance can be considered serious. However, even if the non-compliance is deemed serious, the legal system includes mechanisms to prevent this from resulting in an irreversible situation for the debtor. Individuals involved in the contract are protected, whether they are borrowers, guarantors, or sureties of loans secured by real estate or whose fulfillment is guaranteed by their primary residence.
